hi i just got my first car 5 days ago and today it was hit by a car while i was at work and has ruined the car meaning i wont be able to drive it again, was wondering on what the best thing would be to do due to me having the drivers details but not having any insurance, the police suspect the driver may have been on drugs but i can’t confirm it just yet,was just wondering if the driver was confirmed to be on drugs would the drivers insurance be unavailable to use?
i ask this because i only have 3rd party insurance
also the driver has ignored me all day and ive called and texted but can’t reach them
any help would be awesome

  1. If the person who crashed into you has insurance or not, you’ll need to take them to small claims court…. enjoy.

  2. You have 3rd party insurance which means you are covered for any damage you do to others that is your fault. That isn’t the case here, so your insurance is useless.

    You have to make a claim against the other driver. You need to get a quote to repair your car. If the car is not driveable, the police would have attended, right? So you will have a police event number. Send the other driver a formal letter (registered mail so they have to sign for it and there’s a record that they received it) saying you hold them responsible for the damage to your car which will cost $X to repair and quote the police event number.

    The other driver then gives the letter to their insurer. Their insurer then contacts you and pays you the money. Case closed.

    If the other driver isn’t insured, or their insurance refuses the claim (because they were drunk or whatever – see police report), they can just send you the money. Case closed.

    If they do not pay, you will have to take them to court and sue them for the damages, and win in court, to get them to pay. This will take many months and cost you some money for a lawyer etc.

    If you had comprehensive insurance, you would contact your insurer, they would repair your car or pay you the value of it, usually in a week or so, and you would move on with life. Then they would do all the work to get their money back from the other driver – you wouldn’t have to worry about it.

    Some people don’t get comprehensive insurance “because it’s cheaper not to.” Well you just found out that it is often not cheaper at all.
